These Terms of Use govern your purchase and use of Pena Study Daily, a web application published by Pena Digital Foundation, a nonprofit corporation with offices at 1717 Cagua Dr NE, Albuquerque, NM 87110, United States (“we”, “us”). By buying a plan or using the app you accept these terms. If you do not accept them, do not use the app.
1. What Pena Study Daily is
Pena Study Daily is a study aid: one short daily session, a private notebook, practice cards, a library of study material, guided learning paths, audio lessons and an AI Study Guide. It is educational software. It is not a school, it does not award academic credit, degrees or certificates, and it is not medical, psychological, legal or financial advice.
2. Your access
Each plan grants one person a personal, non-transferable right to use the app for the period stated on the plan, except for Study Circle, Circle Annual and Classroom Kit plans, which include the number of member seats stated. You may not share, resell, sublicense or publish your access link. We may end access without refund if an account is shared beyond the seats bought or used to redistribute our material.
3. Payment
All plans are one-time payments in U.S. dollars, processed by Stripe. There is no subscription and no auto-renewal. We never see or store your full card details. Prices shown include no taxes; any tax that applies where you live is your responsibility.
4. Refunds
Every plan carries a 14-day money-back guarantee, described in full in our Refund Policy.
5. Acceptable use
- Do not use the app to break the law or to harm anyone.
- Do not attempt to access other users' notebooks, probe our systems, or bypass technical limits such as message quotas.
- Do not copy, scrape or republish our library, workbooks or generated material as your own product.
- Do not use the Study Guide to produce work you will submit as your own where that is prohibited. The Study Guide is built to explain and to check your reasoning, and declines to write graded assignments, essays or exam answers.
6. The AI Study Guide
The Study Guide is an AI companion. Its replies are generated automatically and can be incomplete or wrong. Check them against your course material and your teacher's instructions. We do not guarantee the accuracy of any explanation, and you are responsible for the academic consequences of the work you submit.
7. Learners under 18
A learner under 18 should use Pena Study Daily with the involvement of a parent, guardian or teacher, who accepts these terms on their behalf. We do not offer public profiles, messaging between strangers, or advertising of any kind.
8. Your content
Your notes stay yours. You give us only the technical permission needed to store and display them back to you. We do not read, sell, publish or use your notes to train anything. You can export your notebook to PDF or delete it at any time.
9. Our content
The app, its library, its design, its workbooks and its branding belong to Pena Digital Foundation and are protected by copyright. Your plan gives you the right to use them for your own study, not to redistribute them.
10. Availability
We aim to keep the app available at all times, but we do not promise uninterrupted service. Maintenance, third-party outages and technical failures happen. If the app is unavailable for a prolonged period during a timed plan, write to us and we will extend your access or refund you fairly.
11. Limitation of liability
To the extent permitted by law, our total liability for any claim connected to Pena Study Daily is limited to the amount you paid for your plan. We are not liable for indirect losses such as lost grades, lost opportunities or lost data where you had the ability to export it.
12. Ending access
You may stop using the app at any time. We may suspend or end access if these terms are breached, if a payment is reversed, or if the app is used in a way that endangers other users or our systems. Where we end access without cause, we refund the unused part of a timed plan.
13. Changes
We may update these terms as the product changes. The version published on this page, with the date at the bottom, is the one in force. Material changes will be announced by email to buyers before they take effect.
14. Governing law
These terms are governed by the laws of the State of New Mexico, United States, and any dispute will be heard by the courts located there, unless the mandatory law of your country of residence gives you the right to a different forum.
